General Terms and Conditions (GTC) – Restaurant Rechberg 1837
Scope of Application
These General Terms and Conditions govern the legal relationships between guests and BarKaffeeFeldhof GmbH, the operator of Restaurant Rechberg 1837 in Zurich.
Conclusion of Contract
The contract is concluded upon acceptance of the offer, whether for gastronomic services, the rental of premises, or external services in the form of catering, events, or consultations. The scope of the services provided by Restaurant Rechberg 1837 is determined by the reservation or order confirmation. Guests have no right to a specific table or room. Deviating individual agreements remain reserved.
Prices and Payment Obligation
The prices communicated are in Swiss Francs (CHF) and include the applicable VAT. Guests are obliged to pay the agreed or applicable prices for the services received. For reservations amounting to at least CHF 1,000, payment by invoice is possible and preferred. The payment period is 14 days. BarKaffeeFeldhof GmbH reserves the right to make small, product-dependent price adjustments.
Restaurant Rechberg 1837 reserves the right to bill or interim bill for its services at any time. The final invoice includes the agreed price plus any additional amounts resulting from extra services provided by the restaurant for the guest and/or their accompanying persons. Payment can be made via EC, Visa, MasterCard, Twint, or cash; other payment methods are available upon request.
Advance Payment or Deposit
For reservations of 8 or more persons, Restaurant Rechberg 1837 has the right to request a deposit of 50% of the agreed minimum consumption upon reservation confirmation. The amount is due within 14 days; once payment is received, the event is considered definitively reserved.
For the exclusive rental of Restaurant Rechberg 1837, a minimum consumption fee ranging from CHF 5,000 to CHF 9,500 will be charged, depending on the season and day of the week. Any external services are not included in the consumption costs.
Adjustments to Reservations
Changes are possible up to 2 working days before the event begins. The final number of participants for groups must be provided at least 36 hours before the event begins. If the actual number of guests decreases by less than 5% compared to the number specified in the reservation confirmation, the billing of services will be based on the actual number of participants.
Example: For a reservation of 20 people with 19 attendees, billing will only be for 19 people.
If the actual number of guests decreases by more than 5% compared to the number specified in the reservation confirmation, the restaurant reserves the right to charge a compensation fee for each missing guest (between the actual number and the 5% deviation from the reservation) equal to the incurred basic costs. The person making the reservation agrees to pay this compensation. Cancellation provisions remain reserved.
If no guests appear despite a confirmed reservation, a compensation equal to the actual incurred basic costs is owed. Standardized or individual cancellation provisions, agreed in writing directly with Restaurant Rechberg 1837, remain reserved.
Cancellation Provisions
Cancellations or significant changes must be communicated to Restaurant Rechberg 1837 by the guests as early as possible and no later than 36 hours before the reservation via email.
- For a reservation of 1 to 6 persons, a free cancellation is possible up to 36 hours before the agreed reservation. Restaurant Rechberg 1837 reserves the right to charge the incurred basic costs for later cancellations.
- For a reservation of 7 or more persons, free cancellation is possible if the cancellation notice reaches Restaurant Rechberg 1837 10 calendar days before the agreed service at 12:00 PM.
After the specified deadlines, free cancellation is no longer possible. In this case, the provisions regarding "Adjustments to Reservations" in these GTC apply. Restaurant Rechberg 1837 has the right to charge a fee of at least CHF 85.00 per guest or, for reservations of 7 or more persons, 100% of the confirmed offer as a "No-Show Fee."
Withdrawal by Restaurant Rechberg 1837
Withdrawal must be made in writing or via email. It is legally effective if addressed to the person specified in the reservation and to the person who made the reservation.
Restaurant Rechberg 1837 is entitled to withdraw from the contract without giving reasons up to 10 days before the agreed service delivery.
Restaurant Rechberg 1837 is also entitled to withdraw from the contract at any time for objectively justified reasons through unilateral withdrawal.
Justified reasons include, for example: force majeure, epidemics/pandemics, incorrect and/or misleading information provided during the reservation, illegal content of the stay (e.g., sectarian, sexist, racist, or radical ideologies). This list is not exhaustive.
By withdrawing, Restaurant Rechberg 1837 is released from the obligation to provide the agreed services. Guests have no right to claim damages in this case. In the event of justified withdrawal, the compensation for the booked services remains fundamentally owed.
Food and Beverages
Food and beverages may only be obtained from Restaurant Rechberg 1837. In exceptional cases, an alternative agreement may be made for club or corporate events. In such cases, Restaurant Rechberg 1837 reserves the right to charge a service fee or corkage fee. The agreement must be in writing.
Exceptions: Baby food or pet food may be brought from outside.
Liability
Restaurant Rechberg 1837 excludes liability within the legal limits for slight and moderate negligence and is only liable for intentionally or grossly negligent damage. Restaurant Rechberg 1837 is not liable for items brought by guests or third parties and declines any liability for theft and damage to such items.
Guests are liable to Restaurant Rechberg 1837 for all damages and losses caused by them, their companions, or auxiliary persons, without Restaurant Rechberg 1837 needing to prove any fault. Guests are also liable for services and expenses incurred by the restaurant to third parties. Parents are liable for their children.
If third parties have made the booking on behalf of guests, they are jointly and severally liable with the guests to Restaurant Rechberg 1837 for all obligations arising from the contract.
Any damages caused by guests to rooms, facilities, furniture, and outdoor areas will be charged to the guests. Guests are also liable to third parties for any tortious acts.
Applicable Law
Should any provision of these GTC be invalid or should the contract contain a gap, the legal validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, a valid provision shall be deemed to be agreed upon that comes closest to the economic intent of the parties. The same applies in the case of a gap.
Guests acknowledge the location of Restaurant Rechberg 1837 as the court of jurisdiction for all legal disputes in connection with these GTC and the related services. Swiss law applies to the contract.
